Terms of Service

1. Acceptance of Terms
By creating an account or using CBT Assistant Pro ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and CBT Assistant Pro.
2. Eligibility
The Service is intended for licensed mental health professionals, clinical trainees under supervision, and authorized staff within a clinical practice. By registering, you represent that you are a qualified professional or are authorized by one to use the platform.
3. Description of Service
CBT Assistant Pro is a clinical productivity tool that helps therapists with CBT case conceptualization, session documentation, treatment planning, AI-assisted hypothesis generation, and related clinical workflow tasks. The Service includes a voice-enabled AI assistant, transcription capabilities, and a client portal.
The Service is not a medical device. AI-generated content (hypotheses, formulations, session note drafts) are suggestions only and must be reviewed, validated, and approved by a qualified clinician before use in clinical decision-making.
4. Account Responsibilities
- You are responsible for maintaining the confidentiality of your login credentials.
- You must use a strong password meeting our minimum requirements (8+ characters, mixed complexity).
- You must not share your account with unauthorized individuals.
- You must promptly notify us of any unauthorized access to your account.
- You are responsible for all activity that occurs under your account.
5. Clinical Responsibility
You acknowledge and agree that:
- You retain full clinical responsibility for all client care decisions.
- AI-generated content is advisory only and does not constitute clinical advice.
- You must review and validate all AI-generated drafts before clinical use.
- The Service does not replace professional clinical judgment.
- You are responsible for obtaining appropriate informed consent from your clients before entering their data into the platform.
- You comply with all applicable professional ethics codes, licensing requirements, and regulations.
6. HIPAA Compliance
For users subject to HIPAA, CBT Assistant Pro will enter into a Business Associate Agreement (BAA) upon request. We implement administrative, technical, and physical safeguards as described in our Privacy Policy.
You are responsible for:
- Ensuring you have a valid BAA with us before entering PHI
- Obtaining patient authorization where required by HIPAA
- Using the Service on secure, controlled devices
- Configuring appropriate session timeout settings
- Reporting any suspected breaches to us immediately
7. GDPR Compliance (EU Users)
For users in the European Economic Area (EEA):
- We process your data as described in our Privacy Policy.
- We act as Data Processor for client PHI; you are the Data Controller.
- A Data Processing Agreement (DPA) is available upon request.
- You may exercise your GDPR rights (access, rectification, erasure, portability) through your Account Settings or by contacting us.
- Data transfers outside the EEA are governed by Standard Contractual Clauses.
8. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to reverse-engineer, decompile, or extract source code
- Interfere with the Service's security or integrity
- Access another user's data without authorization
- Use automated bots or scrapers against the Service
- Upload malicious content, viruses, or harmful code
- Resell or sublicense access to the Service
9. Subscription & Billing
- The Service offers free trial and paid subscription plans.
- Paid plans are billed monthly or annually via Stripe.
- You may cancel your subscription at any time from Account Settings.
- Cancellation takes effect at the end of the current billing period.
- Refunds are available within 14 days of initial purchase for EU customers (right of withdrawal).
- We reserve the right to change pricing with 30 days' notice.
10. Data Ownership
You own your data. All clinical data, notes, formulations, and other content you create using the Service remains your intellectual property. We do not claim ownership of your content.
You grant us a limited license to process your data solely for the purpose of providing the Service. This license terminates when you delete your account.
11. Intellectual Property
The Service, including its software, design, documentation, and branding, is owned by CBT Assistant Pro and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written consent.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CBT ASSISTANT PRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, CLINICAL OUTCOMES, OR BUSINESS INTERRUPTION.
Our total liability for any claim arising from or relating to the Service shall not exceed the amount you paid us in the 12 months prior to the claim.
Nothing in these Terms excludes liability for death, personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.
13. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
14. Termination
- You may terminate your account at any time through Account Settings.
- We may suspend or terminate your account for violation of these Terms.
- Upon termination, you may export your data within 30 days.
- After the 30-day grace period, your data will be permanently deleted.
15. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. For EU residents, mandatory consumer protection laws of your country of residence shall apply where they provide greater protection.
16. Dispute Resolution
Any disputes arising from these Terms shall first be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association. EU residents retain the right to bring claims before their local courts.
17. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
